2. Collection and storage of personal data and the nature and purpose of its use

When you visit our website www.imbeck-law.de, the browser used on your device automatically sends information to our website's server. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until it is automatically deleted:
  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the file accessed,
  • website from which access is made (referrer URL),
  • Browser used and, if applicable, the operating system of your computer and the name of your access provider.

We process the aforementioned data for the following purposes:

  • Ensuring smooth connection to the website,
  • ensuring comfortable use of our website,
  • evaluating system security and stability, and
  • for other administrative purposes.

The legal basis for data processing is Art. 6 (1) (f) GDPR. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person. 3.

3. Disclosure of data

Your personal data will not be transferred to third parties for purposes other than those listed below.
We will only disclose your personal data to third parties if:
  • you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,
  • the transfer is necessary for the establishment, exercise or defence of legal claims pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data
  • ,
  • in the event that there is a legal obligation for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and
  • this is legally permissible and necessary for the performance of contractual relationships with you pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR.

3. SSL- bzw. TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Rights of affected persons

You have the right:
  • pursuant to Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if it was not collected by us, and the existence of automated decision-making, including profiling and, if applicable, meaningful information about its details;
  • to request the immediate correction of inaccurate or incomplete personal data stored by us in accordance with Art. 16 GDPR;
  • to request the erasure of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to have it deleted and we no longer need the data process or use it;
  • pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to have it deleted and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have objected to the processing pursuant to Art. 21 GDPR;
  • pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transfer to another controller;
  • pursuant to Art. 7(3) GDPR, to withdraw your consent at any time. As a result, we will no longer be permitted to continue processing data based on this consent in the future; and
    in accordance with Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our law firm's registered office for this purpose.

5. Handling of applicant data

We offer you the opportunity to apply to us by email. When you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes taken during interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) (initiation of an employment relationship), Article 6(1)(b) of the GDPR (general contract initiation) and – if you have given your consent – Article 6(1)(a) of the GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If your application is successful, the data you submit will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 (1) (b) GDPR for the purpose of implementing the employment relationship.

If we are unable to offer you a position, you decline a job offer, or you withdraw your application, we reserve the right to store the data you have provided on the basis of our legitimate interests (Art. 6 (1) (f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The storage serves in particular for verification purposes in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 (1) (a) GDPR) or if statutory retention obligations prevent deletion.

7. Rights of objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) (f) GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right to object, which we will implement without you having to specify a particular situation.

8. Data protection

We use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.

9. Current status and changes to this privacy policy

This privacy policy is currently valid and was last updated in May 2018.
Due to the further development of our website and the services offered on it, or due to changes in legal or regulatory requirements, it may become necessary to amend this privacy policy.
